Rubbish Removal Chiswick Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Chiswick provides rubbish removal, waste collection and related services to domestic and commercial customers. By making a booking, confirming a quotation, or allowing our team to carry out work at your premises, you agree to be bound by these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions, you must not use our services. These terms apply to all waste collection and rubbish removal services we provide within our service area, unless we agree otherwise in writing.
Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Company, we, us, our means Rubbish Removal Chiswick as the provider of rubbish removal and waste collection services.
Customer, you, your means the individual, business, or organisation requesting or receiving our services.
Services means any rubbish removal, waste collection, clearance, loading, transportation, and disposal services carried out by us.
Booking means any request for services made by you and accepted by us, whether by telephone, email, online form, or other method.
Waste means any items, materials, or rubbish to be collected and removed by us as part of the agreed services.
Scope of Services
We provide rubbish removal and waste collection services for household, garden, office, commercial, and builders waste, subject to relevant legislation and our own operational limits. The exact scope of the services to be provided in each case will be set out in the booking confirmation or agreed quotation.
We reserve the right to refuse to collect certain items or types of waste, including but not limited to hazardous materials, clinical or medical waste, asbestos, gas bottles, chemicals, and any items that we reasonably believe may pose a health and safety risk or contravene waste regulations.
Where we agree to collect particular items as a special service, additional charges may apply, and we may require extra information prior to confirming the booking.
Booking Process
You can request a rubbish removal or waste collection service by contacting us via telephone, email, or any booking form we make available. When you make a booking request, you must provide accurate information, including but not limited to:
The type and approximate volume or weight of waste to be removed.
The location and access details for the collection site.
Any restrictions, parking limitations, or specific site conditions that could affect our ability to perform the services.
Based on the information you provide, we may supply a quotation or an estimate. A booking is only confirmed when we accept your request and give you a booking confirmation, which may be by email, text message, or verbal confirmation.
We reserve the right to amend or withdraw a quotation if the information you have provided is inaccurate or incomplete, or if the actual waste volume or access conditions differ when our team arrives on site.
Quotations, Estimates and Pricing
Prices for rubbish removal and waste collection are generally based on the type of waste, the estimated volume or weight, the labour required, and any additional costs such as parking charges or disposal fees. Any quotation we provide is based on the information you supply at the time.
Where we provide an estimate rather than a fixed quotation, this is not a binding price and may be adjusted on the day of service if the actual waste volume, type, or site conditions differ from those originally described. Our team will assess the waste on arrival and confirm any changes to the price before commencing work.
All prices are quoted in pounds sterling. Unless specifically stated otherwise, prices are exclusive of any applicable taxes, duties, or third-party charges that may be added to the final invoice where required by law.
Payments and Invoicing
Payment is due in full on completion of the services, unless we have agreed an alternative arrangement in writing before the work begins. We may require upfront payment or a deposit for larger or commercial rubbish removal projects.
We accept various forms of payment, which may include cash, debit or credit card, bank transfer, or other methods that we notify to you from time to time. Where payment is taken by card, you authorise us or our payment processor to charge the agreed amount on completion of the work.
If payment terms have been agreed on account, invoices must be paid within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date. We reserve the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in pursuing late payments, including collection and legal fees.
We may refuse to carry out or complete a rubbish removal or waste collection if payment is not made in accordance with these Terms and Conditions.
Cancellations and Amendments
You may cancel or amend a booking by contacting us directly. To avoid charges, you must give us reasonable notice of cancellation or change. As a general guide, we request at least 24 hours notice for standard waste collection bookings.
If you cancel with less than 24 hours notice, we may charge a cancellation fee to cover our administrative and scheduling costs. If our team has already been dispatched to your location at the time of cancellation, a call-out charge may apply.
Where you wish to change the date, time, or scope of services, we will try to accommodate your request, but we cannot guarantee availability. Any changes are subject to our approval and may affect the price. If we are unable to accommodate changes, the original booking and any associated charges may still apply.
We reserve the right to cancel or reschedule a booking at any time if we are unable to perform the services due to reasons beyond our reasonable control, such as severe weather, transport disruption, staff illness, or safety concerns at the collection site. In such cases, we will offer an alternative appointment where possible, and any advance payment for services not provided will be refunded.
Access, Parking and Customer Obligations
You are responsible for ensuring that we have safe, reasonable, and legal access to the property or site where the rubbish removal or waste collection is to be carried out. This includes arranging any necessary permissions, providing accurate directions, and informing us of any potential access issues.
You must ensure that adequate parking is available for our vehicle as close as reasonably possible to the collection point. Any parking charges or fines incurred as a result of your failure to provide adequate information or permissions may be added to your invoice.
Waste must be presented in a way that is safe for our team to handle. Where reasonably possible, items should be consolidated into an accessible area. If items are to be collected from inside a property, communal area, or inaccessible location, you must inform us at the time of booking. Additional labour charges may apply for collections that require extra handling time or difficult access.
You must not present for collection any waste that is prohibited under these Terms and Conditions or under applicable waste and environmental regulations. If we discover such items on arrival, we may refuse to remove them and may charge for the wasted journey and time.
Performance of Services
Our team will carry out the agreed rubbish removal or waste collection with reasonable care and skill, in line with industry practice and applicable legislation. We will use our professional judgement to determine how best to load, transport, and dispose of your waste.
We will make reasonable efforts to arrive within the time slot agreed, but any times provided are estimates and are not guaranteed. We will not be liable for any loss or damage arising from delays or failure to attend at a specific time, where such delays are caused by factors beyond our reasonable control.
Once the service is complete, our team may ask you to confirm that the waste has been removed to your satisfaction. You are responsible for checking the area before our team leaves the site and raising any concerns immediately.
Waste Handling and Regulations
We operate in accordance with relevant UK waste management legislation and regulations. All waste collected as part of our rubbish removal and waste collection services will be transported and disposed of at authorised facilities, with the objective of minimising environmental impact and maximising recycling where reasonably possible.
By using our services, you confirm that you are the owner of the waste or have full authority to arrange its removal. You must not instruct us to remove any waste that has been fly-tipped without the permission of the landowner or relevant authority.
We may issue a waste transfer note or similar documentation as required by law. You agree to retain any such documents we provide, where necessary, and to cooperate with us in providing any information required for regulatory compliance.
If we reasonably suspect that the waste you have presented includes prohibited, hazardous, or misdescribed materials, we may refuse to collect it, segregate such materials, or suspend the service until we have clarified the situation with you. Any additional costs arising from such circumstances, including special handling or disposal charges, may be passed on to you.
Damage, Liability and Insurance
We will take reasonable care when carrying out rubbish removal and waste collection services on your premises. However, you acknowledge that some risk of minor damage is inherent in moving bulky or heavy items, particularly in confined spaces or where access is restricted.
We will not be liable for:
Any pre-existing damage to property, fixtures, fittings, or items.
Minor scuffs, marks, or scratches reasonably attributable to the normal course of moving waste, where due care has been exercised.
Any damage or loss arising from your failure to properly inform us about fragile areas, hidden services, or vulnerable surfaces.
Our total liability for any loss or damage arising out of or in connection with our services, whether in contract, tort, or otherwise, shall not exceed the price paid or payable for the specific service in question, except where such limitation is prohibited by law.
Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under UK law.
You are responsible for removing or securing any valuables, fragile items, or sensitive equipment from the areas where our team will be operating. We will not be liable for loss or damage to items that should reasonably have been removed from the work area by you.
Customer Conduct and Safety
We reserve the right to refuse to carry out or to discontinue a rubbish removal or waste collection if our staff are subjected to abuse, threats, or unsafe conditions. This includes situations where violence, harassment, or serious health and safety risks are present.
You must not instruct our team to carry out any task that falls outside the agreed services or that would breach health and safety rules, waste regulations, or these Terms and Conditions.
Complaints and Disputes
If you have any concerns or complaints about our rubbish removal or waste collection service, you should notify us as soon as possible, and in any event within 7 days of the service being carried out. We may ask you to provide details, including photographs or written information, to help us investigate.
We will endeavour to resolve complaints promptly and fairly. Where appropriate, we may offer to rectify any issues, provide a partial refund, or take other reasonable steps. Any remedy we offer will be at our discretion and subject to our assessment of the circumstances.
Data Protection and Privacy
In the course of providing our services, we may collect and process personal data relating to you, such as your name, contact details, address, and payment information. We will handle such data in accordance with applicable data protection laws and use it only for legitimate purposes connected with the provision of our services, administration, and legal compliance.
By using our services, you consent to the processing of your personal data for these purposes. You may contact us to request access to, correction of, or deletion of your personal information, subject to legal and regulatory requirements.
Variation of Terms
We may amend these Terms and Conditions from time to time to reflect changes in law, regulation, or our business practices. The version in force at the time you make a booking will apply to that booking. We recommend that you review the current Terms and Conditions each time you arrange a new rubbish removal or waste collection with us.
Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the provision of our services, shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
Severability
If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid, unlawful, or unenforceable, such provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.
Entire Agreement
These Terms and Conditions, together with any written quotation, booking confirmation, or agreed variations, constitute the entire agreement between you and us in relation to the rubbish removal and waste collection services we provide. You acknowledge that you have not relied on any statement, promise, or representation that is not set out in these documents.
By arranging or accepting a booking with Rubbish Removal Chiswick, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
